Terms of use

SIA "ProfKey", registration No. 40003538768, legal address: Mellužu prospekts 66A-2, LV-2008, Jūrmala, Latvia, hereinafter - ProfKey - provides the content available on the website and provides services for interest education classes in accordance with the Terms of Use set out below. By paying the invoices, you agree to these Terms of Use.


Parties:

  • ProfKey - service provider
  • Student - a child attending a class
  • Client (parents) - the student's father/mother/guardian

1. General provisions

If the client, using the website, reserves and pays for interest education classes, then such a mutual agreement is considered a Distance Agreement and is subject to the legal norms of the Republic of Latvia that regulate distance contracts, including, but not limited to, the "Consumer Rights Protection Law" of the Republic of Latvia, the regulations of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contracts", etc.


2. Booking classes

Prices and descriptions of classes available on the website are indicated next to each class.

To make a reservation, select the desired class and time. Fill in all required fields. The total cost of the reservation is displayed on the screen. Make a payment to complete the reservation.

3. Payment terms

The membership fee depends on the number of classes selected, current prices are visible on the club's website - jaunaispetnieks.lv

Classes require a prepayment, for which an invoice is sent to the Parents to the e-mail address provided by them, which must be paid before the Student attends the relevant class or starts the class cycle (in case of a subscription).

The Service Provider has the right to request payment for classes that the Student has not attended and about which the Parents have not informed the Service Provider in a timely manner in accordance with clause 3.2. of this agreement.

In exceptional cases, when the invoice has not been paid before the lesson time, Parents are obliged to pay the invoice within five calendar days after the lesson date to the Service Provider's bank account LV37HABA0551060362936, indicating "New Researcher Challenge", the Student's name, surname and personal identification number in the payment purpose.

The settlement currency on the website is euros. Payment can be made by choosing the following payment methods

  • Latvian internet banking payments: Swedbank, SEB, Citadele and Luminor
  • Visa/Mastercard card payments (provided by Swedbank EveryPay)

NB! Using the internet banking payment method, confirm the reservation and click on the "Return to merchant" button.

If for some reason it is not possible to provide the reserved lesson, the client will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after receiving the notification.

4. Terms of provision of classes

Classes are provided in person at the premises of the Korso shopping center, located at Jomas iela 37, Jurmala, LV-2015, Latvia. Classes are available to all children whose parents have successfully made a reservation and payment.

Class reservations are made using our online reservation system. The reservation is considered confirmed after successful payment.

All fees and taxes related to the payment of classes are included in the price. Class prices are displayed before the reservation is confirmed.

Children must arrive at the class venue at least 5-10 minutes before the start of the class. If a child is late for more than 10 minutes, we reserve the right to refuse participation in the class without compensation.

In exceptional cases (for example, due to the illness of teachers or unforeseen circumstances), we have the right to postpone or cancel the class, informing the client (parents) about this at least 2 hours before the scheduled start of the class. In such cases, the client is offered the opportunity to reschedule the lesson or receive a full refund.

The Service Provider has the right to demand from the Parents payment for material losses caused to the Service Provider due to the fault of the Student.

The Student undertakes to observe safety regulations during the lessons, to be careful with educational materials and the personal belongings of other students.

The Student undertakes to observe generally accepted social norms of behavior during the lessons, to behave politely towards the instructors of the group and other students, to keep their workplace clean and tidy, and to arrange the used educational materials after the lesson.

The Student must follow the instructions of the instructors during the lessons.

The Student/Parents have the right to contact the lesson leader with suggestions or dissatisfaction, and to express special wishes regarding possible improvements in the activities of the group.

The Service Provider has the right to make video recordings, take photographs and use the obtained materials, which may include Students, for the purposes of the Service Provider's marketing and its activities.

5. Cancellation and Refund Policy

The Client has the right to cancel the booked lesson free of charge no later than 24 hours before the start of the lesson. Cancellations made less than 24 hours before the lesson are not compensated, except in exceptional cases (e.g. sudden illness), which are considered individually.

The Client is obliged to inform ProfKey at least 24 hours in advance that the child will not attend the lesson by sending information to the e-mail address [email protected] or via SMS/Whatsapp to the phone number +37126535421.

If the Client does not arrive for the booked lesson without prior notice, the lesson is considered used and is not compensated.

In the event that a lesson needs to be canceled due to technical reasons or unexpected absence of the instructor, the client is offered the option to reschedule the lesson or receive a full refund.

In the case of subscriptions:

- If the subscription has been partially used, the refund is calculated by deducting the value of the lessons used after the full price of one lesson.

Refunds are made to the same payment method used for the original purchase within 14 days of receiving the cancellation request.

ProfKey reserves the right to refuse services to clients who repeatedly violate the studio rules or pose a threat to the safety of other clients or staff.

ProfKey is not responsible for delays in fulfilling or non-fulfillment of obligations, or other non-performance due to circumstances and obstacles beyond its reasonable control (e.g. natural disasters, government orders).

ProfKey reserves the right to correct obvious errors in prices or lesson descriptions. If an error is discovered after a booking has been made, we will offer the customer the option to confirm the booking at the correct price or cancel it with a full refund.

6. Client's rights regarding the quality of services

SIA ProfKey is responsible for the quality of the service provided (interest education classes) and its compliance with the description. If the client believes that the service received does not meet the promised or is of lower quality than expected, he has the right to file a complaint.

The client must inform SIA ProfKey about the non-compliance of the service or quality problems as soon as possible, but no later than 2 months after attending the class. The complaint can be filed by contacting us by e-mail [email protected].

SIA ProfKey is not responsible for changes in the child's health or injuries that have occurred if the child has not followed the teacher's instructions or has withheld information about his health.

If it is determined that the service provided does not meet the promised or is of lower quality, SIA ProfKey will offer one of the following solutions:

  1. Free additional class;
  2. An appropriate discount for the next purchase;
  3. Partial or full refund for the specific class.

The solution will be selected taking into account the specifics of the situation and in consultation with the client.

SIA ProfKey undertakes to provide a written response to the client's complaint within 15 days of its receipt.

We strive to provide the highest quality services and are open to constructive feedback in order to continuously improve the quality of the services we provide.

7. Processing of client personal data

SIA ProfKey processes only the personal data that the client has entered when registering for classes. This data may include name, surname, personal identification number, as well as your child's name, surname and personal identification number, e-mail address and telephone number.

We do not use or transfer the client's personal data to third parties, except in cases where it is necessary to provide the service (for example, to process payments) or when required by law.

If the client has agreed to receive our marketing communications, we may occasionally contact the client by sending information about our services, the latest offers and healthy lifestyle tips. For this purpose, we use the email address provided by the customer.

The customer has the right to opt out of receiving marketing communications at any time by informing us about this by writing to [email protected].

We adhere to strict data protection standards and process customer personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

8. Dispute Resolution Procedure

In all matters not covered by these terms and conditions, SIA ProfKey and the client undertake to comply with the laws and regulations in force in the Republic of Latvia.

We will try to resolve any disputes or disagreements between SIA ProfKey and the client through mutual negotiations or correspondence. We encourage clients to first contact us via e-mail [email protected] to discuss the situation and seek a mutually acceptable solution.

If the dispute cannot be resolved through negotiations or correspondence, both parties agree to resolve the dispute in the court of the Republic of Latvia, in accordance with the laws and regulations of the Republic of Latvia.

The client (consumer) also has the right to contact the Consumer Rights Protection Center for assistance in resolving the dispute. Information on out-of-court dispute resolution options and platforms can be found on the website of the Consumer Rights Protection Center: www.ptac.gov.lv.

If the customer is a resident of another European Union member state, he or she also has the right to use the European Union's Online Dispute Resolution (ODR) platform, available here: https://ec.europa.eu/consumers/odr/.

SIA ProfKey undertakes to participate in any dispute resolution process in good faith and constructively, striving to achieve a fair and mutually acceptable solution.
